Sublease agreement

The sublease agreement is a contract template for subletting premises — the landlord's consent, the part being sublet, rent and duration. It suits subletting a whole flat or a single room.

What is this contract?

With a sublease agreement, a tenant passes on the premises rented to them, in part or in full, to a third person. Two things determine whether this works at all. First, consent: subletting as a rule requires the head landlord's permission, and without it the whole arrangement may be a breach of the head lease that gives the owner the right to terminate it. Second, scope: a subtenant cannot acquire more rights than the sublandlord has, and the sublease ends at the latest together with the head lease — even if a longer term is written into the sublease agreement.

Frequently asked questions

Do I need the landlord's permission to sublet?

As a rule, yes. The template asks separately whether consent exists and writes a clear warning into the agreement if there is no consent yet.

Can a sublease last longer than the head lease?

No. The sublease ends at the latest together with the head lease, regardless of the term written into the sublease agreement.

May I sublet just one room?

Yes. The template covers the whole premises, one room and part of the premises, and lets you describe which rooms remain in shared use.
